For over 20 years, I have worked in the field of strategic legal communication, a communications discipline I first encountered in the United States and subsequently introduced to Europe under the term Litigation PR after my return from the United States to Germany in 2002. The service portfolio of our company, NAÏMA Strategic Legal Services GmbH, has since expanded to include crisis communication, reputation management, and now also disinformation crisis management. Working in this field means that, among other things, we act on behalf of our clients (mainly companies or high-net-worth individuals), in cooperation with media lawyers, to counter unfavorable or even false reporting and to communicate accordingly. Not infrequently, during legal disputes, it became apparent that journalists had fallen for false or fabricated information supplied to them by interested parties. These planted pieces of disinformation appeared so enticing to the journalists that they neglected the journalistic caution and diligence required prior to publication. Eliminating such damaging information for our clients has been, and remains, part of our daily work. As someone with a keen interest in politics, I could not fail to notice how perceptions of truth and facts have changed in recent years. Trump’s election campaigns (Part I and Part II), Brexit, Bolsonaro in Brazil, right-wing populist parties in Germany, France, and Italy, and Russian disinformation campaigns in Europe and Africa provided the backdrop for a period described as “post-factual,” which would ultimately culminate in the coronavirus crisis. State actors (Russia and China), political actors (right-wing populists), and private actors exploited this extraordinary situation, each driven by different motives, to attack the manufacturers of COVID vaccines. This caught my attention. Could it be that what we had previously associated with the political sphere—namely fake news and deliberately spread disinformation—was now crossing over into the economic sphere? Reliable information and stable communication channels are the lifeblood of our modern economy. Could it be that this foundation of free societies is now increasingly exposed to disinformation attacks, unleashing their enormous destructive potential and causing devastating economic consequences? I wanted to find answers to these questions and began my research. At that time, the database was still thin, and there was barely any understanding of what might distinguish disinformation attacks from cyberattacks.
